You are solely responsible for your interactions with other users. You should exercise caution and good judgment when interacting with others, especially when meeting in person. We are not responsible for any damages or harm resulting from your interactions with other users.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NAUGHTYDATE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
IN NO EVENT SHALL NAUGHTYDATE'S AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES EXCEED THE GREATER OF $100 USD OR THE AMOUNT YOU PAID NAUGHTYDATE, IF ANY, IN THE PAST 12 MONTHS FOR THE SERVICES GIVING RISE TO THE CLAIM.
The limitations in this Section 9 are fundamental elements of the basis of the bargain between NaughtyDate and you. The Services would not be provided without such limitations.

For any dispute with NaughtyDate, you agree to first contact us and attempt to resolve the dispute informally. If we cannot resolve the dispute informally, we each agree to resolve any claim, dispute, or controversy through binding arbitration rather than in court.
YOU AND NAUGHTYDATE AGREE THAT ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL BE RESOLVED BY BINDING ARBITRATION, RATHER THAN IN COURT.
YOU AND NAUGHTYDATE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
These Terms shall be governed by the laws of the State of California, without regard to its conflict of law provisions.
The Services and their original content, features, and functionality are owned by NaughtyDate and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
The Services may contain links to third-party websites or services that are not owned or controlled by NaughtyDate. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites or services.
You agree to defend, indemnify, and hold harmless NaughtyDate and its licensors from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses arising from your use of the Services or violation of these Terms.
We shall not be liable for any failure to perform our obligations hereunder where such failure results from any cause beyond our reasonable control, including mechanical, electronic, or communications failure.
If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent possible, and the remaining provisions will remain in full force and effect.
